01. Agreement to Terms

By accessing or using the Upwatch platform, you agree to be bound by these Terms of Service. If you do not agree to all of the terms and conditions, you are expressly prohibited from using the service and must discontinue use immediately.

These terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity, and Upwatch. We reserve the right to modify these terms at any time, with updates indicated by the "Last Updated" timestamp at the top of this document.

02. Description of Service

Upwatch provides real-time HTTP uptime monitoring, incident detection, and automated alerting services. Our platform offers:

03. User Obligations

To maintain system stability and security, all users must comply with the following:

REQ_01

Provide a valid email address for account registration and incident communication.

REQ_02

Do not use the service to monitor endpoints you do not own or have authorization to check.

REQ_03

Do not attempt to probe, scan, or exploit Upwatch infrastructure beyond the documented API.

REQ_04

Comply with rate-limiting and usage policies as specified in the documentation.

04. Intellectual Property

The Upwatch platform, including all source code, databases, functionality, software, website designs, text, and graphics (collectively, the "Content") and the trademarks, service marks, and logos contained therein are owned or controlled by us or licensed to us.

"The monitoring logic, dashboard interfaces, and proprietary alerting systems remain the exclusive property of Upwatch and are protected by copyright and trademark laws."

05. Limitation of Liability

Upwatch provides monitoring services on an "as is" and "as available" basis. While we strive for high availability, we do not guarantee uninterrupted service. We are not liable for any damages arising from:

  • removeMissed alerts due to webhook delivery failures on your receiving end
  • removeTemporary service interruptions for maintenance or infrastructure updates
  • removeData loss beyond the configured retention period
  • removeActions taken or not taken based on monitoring data

06. Termination

These Terms of Service shall remain in full force and effect while you use the platform. We reserve the right to, in our sole discretion and without notice or liability, deny access to and use of the service to any person for any reason, including breach of these terms.

You may delete your account at any time from the Settings page. Upon account deletion, all monitors will stop, and all associated data (monitors, check history, incidents, alerts) will be permanently removed.

If we terminate or suspend your account for any reason, you are prohibited from registering a new account under your name, a false name, or the name of any third party.
